Our online store is powered by Shopify, which serves as our primary platform host and transaction processor, and enables us to provide to you a curated shopping experience, in connection with the Eli’s-branded content, functionality, features, activities, and events hosted by Eli's Cheesecake, whether online or offline (collectively, the “Services”).

1. GEOGRAPHIC SCOPE
Eli's Cheesecake operates in and is based in the United States. The Sites and Services are intended for and directed to a U.S. audience, and all orders for Eli’s products purchased through the Sites and Services will be shipped exclusively to locations within the United States. If you access the Sites and Services from outside the United States, any information we obtain about you will be transferred to and processed in the United States or other jurisdictions outside your own, and may be accessed by the courts, law enforcement, and national security authorities in those jurisdictions. As mentioned above, Eli’s may receive and store any information that you intentionally provide to us
when you, for example, create an Eli’s store account, order Eli’s products, fill out any forms on our Sites,
such as to respond to surveys or enter contests or sweepstakes, willingly submit materials to us, or otherwise voluntarily
engage with Eli’s through the
Sites and Services. This information may include:
- Contact information (email address, phone number).
- Basic personal information such as your name and postal address.
- Your payment information (such as credit card details).

SMS/Text Messaging Personal Information
In the event that you provide to us your mobile telephone number and affirmatively consent to receive SMS/Text messages from us, we may collect:

Cookies And Tracking Technologies
Eli's and its authorized partners use the following technologies for this automated data collection:
- Browser Cookies (“Cookies”). A small text file placed by a website's server on the hard drive of your device.
- Web Beacons. Our emails and pages of our Sites may contain web beacons (aka tracking pixels, single pixel GIFs, or clear GIFs) that can track user activity to signal when content has been loaded or viewed.
- Data analytics tools. We may also use the above technologies to collect data about your online activities over time and across third-party websites. To do this, Eli’s uses Google Analytics Advertising Features (“GA4”) including dynamic remarketing and behavioral reporting, an analytics service provided by Google LLC to track and analyze website traffic and user interactions, a common technique referred to as behavioral tracking.

- Cookie Preferences: Most browsers accept cookies by default. You can adjust your browser settings to remove or decline cookies. Instructions for popular browsers are available at https://www.usa.gov/optout-instructions. However, if you refuse to accept cookies, you may be unable to access certain parts of the Sites. Unless you have adjusted your browser settings to refuse cookies, our system will issue cookies when you direct your browser to the Sites.
- Analytics Opt-Out: To opt out of Google Analytics tracking and targeted advertising, visit https://myadcenter.google.com and tools.google.com/dlpage/gaoptout/.
- Do Not Track & GPC Signals: Our Sites recognize Global Privacy Control (GPC) opt-out preference signals. If our Sites detect a valid GPC signal from your devise or browser agent we will automatically process it as a binding directive to opt you out of the use of your personal data for cross-context behavioral advertising without requiring any further action or submission from you. Because no uniform standard exists for standard browser Do Not Track (DNT) headers, other DNT signals are not currently processed.

5. HOW WE DISCLOSE PERSONAL INFORMATION
Eli’s does not disclose your information to any third party except as explained in this Privacy Policy. From time to time, Eli’s may establish a contractual business relationship with persons or entities whom we believe trustworthy and whose privacy practices are consistent with ours (“Service Providers”). These Service Providers assist Eli’s with the support services such as web hosting, online store platform, data management, credit card processing, printing, shipping, and promotion and marketing services that enable us to fulfill our customers’ Eli’s orders, deliver Eli’s Cheesecake products nationwide, and improve and promote Eli’s products and services. Our Service Providers are not authorized to use or disclose your information except as necessary to perform services on our behalf or comply with legal requirements. The agreements in place between Eli’s and these Service Providers require them to collect, use, and disclose your information only to the extent necessary to allow them to perform the services they provide for us. Each Service Provider must agree to implement and maintain reasonable and appropriate security procedures and practices to protect your information from unauthorized access, use, destruction, alteration, or disclosure.
We disclose personal information only as necessary to fulfill business operations, execute contracts, comply with law, or as directed by you:
- Shopify Platform Integration: Our store is hosted by Shopify. Information submitted through the Sites is transmitted to Shopify to enable store infrastructure, payment processing, fraud detection, and order management. Shopify processes data in accordance with the Shopify Consumer Privacy Policy.
- Contracted Service Providers: We share data with third-party service providers bound by strict confidentiality and security obligations. We may provide this information to telecommunication providers, messaging platforms, carriers, and other service providers strictly as necessary to deliver and support our Eli’s SMS program.

10. CHILDREN’S PRIVACY
Our Sites and Services are not directed to children under 13 years of age. Eli's does not knowingly collect, solicit, or sell personal information from children. If a parent or guardian discovers that a child under 13 has submitted personal information without consent, please contact us immediately at customerservice@elicheesecake.com for prompt deletion.
